Terms and Conditions for KIO EV

  1. Introduction These Terms and Conditions (“Terms”) govern the use of services provided by KIO EV (“Company”), including the rental, sale, and servicing of electric two-wheelers (“Vehicles”). By engaging with our services, you agree to comply with these Terms.
  2. Eligibility
  • Age Requirement: Customers must be at least 18 years old to rent or purchase a Vehicle.
  • License Requirement: Customers must possess a valid driving license for the appropriate class of vehicle.
  • Identification: Customers must provide valid identification and address proof.
  1. Rental Terms
  • Rental Period: The minimum rental period is 7 days. Extensions are subject to availability and must be requested before the rental period expires.
  • Rental Fee: The rental fee is calculated based on the duration of the rental period. Additional charges apply for late returns.
  • Security Deposit: A refundable security deposit of ₹2000 is required before the rental period begins. The deposit will be refunded upon the vehicle’s return in the same condition as it was rented, subject to deductions for damages, if any.
  • Weekly Installments: Rental payments can be made in weekly installments as per the chosen rental plan. Payments must be made on time according to the agreed schedule.
  • Usage Restrictions: The Vehicle may only be used for personal purposes and within the geographical limits specified by the Company. Sub-renting, racing, or off-road use is strictly prohibited.
  1. Sales Terms
  • Price: The sale price of Vehicles is as listed on the Company’s official website or as quoted in the sales agreement. Prices are subject to change without notice.
  • Payment: Full payment is required at the time of purchase unless financing options have been agreed upon. Accepted payment methods include [list payment methods].
  • Warranty: All Vehicles come with a [1] month warranty, covering manufacturing defects. The warranty does not cover wear and tear, misuse, or damage caused by accidents.
  • Return and Refund Policy: Customers may return the Vehicle within 3 days for a refund, provided the Vehicle is in its original condition. A restocking fee may apply.
  1. Service Terms
  • Service Packages: The Company offers various service packages, which may include regular maintenance, repairs, and battery replacement. Details of each package are available on request.
  • Service Appointments: Customers must schedule service appointments in advance. Missed appointments may result in a rescheduling fee.
  • Service Warranty: All repairs and services are covered by a [1] month warranty. The warranty does not cover damage caused by misuse or accidents.
  • Replacement Parts: Only genuine parts are used in the repair and maintenance of Vehicles. Customers may not provide their own parts unless approved by the Company.
  1. Liability and Insurance
  • Insurance: Customers are required to have appropriate insurance coverage for the Vehicle during the rental period. The Company is not liable for any damage, loss, or injury caused by the customer’s use of the Vehicle.
  • Liability: The Company is not responsible for any indirect, incidental, or consequential damages arising from the use of the Vehicle. The customer’s liability for damages during the rental period is limited to the value of the Vehicle.
  1. Customer Obligations
  • Vehicle Care: Customers are responsible for maintaining the Vehicle in good condition. Any damage or loss of the Vehicle during the rental or sales process will be the customer’s responsibility.
  • Compliance with Laws: Customers must comply with all applicable traffic and safety laws while using the Vehicle.
  • Return Condition: The Vehicle must be returned in the same condition as it was rented or as specified in the sales agreement. Cleaning fees may apply if the Vehicle is returned in an unsatisfactory condition.
  1. Termination of Agreement
  • By the Company: The Company reserves the right to terminate the agreement at any time if the customer breaches any of the Terms. In such cases, the customer must return the Vehicle immediately.
  • By the Customer: The customer may terminate the rental agreement at any time by returning the Vehicle. No refund will be provided for early returns unless otherwise agreed.
  1. Dispute Resolution
  • Governing Law: These Terms are governed by the laws of Haryana.
  • Arbitration: Any disputes arising from these Terms will be resolved through binding arbitration in Gurgaon, Haryana, except where prohibited by law.
  1. Changes to Terms The Company reserves the right to modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Company’s website or other communication channels.
